This Agreement is an agreement between you and Aviglatt.com.com that states the terms and conditions under which you may use the Site and receive the Aviglatt.com.com service, which includes processing and delivery of product orders. Note that special terms for corporate depot and for Aviglatt.com.com Corporate Services customers are contained at the end of this Agreement and where applicable those terms supplement or to the degree that they are inconsistent, supersede these terms. Your use of Aviglatt.com.com service and the Site constitutes your agreement to the terms and conditions set forth below. If you do not agree with all of the terms and conditions, do not use the Site or the Aviglatt.com.com Service. If you have any questions about this Agreement or the Site please access our Customer Agreement Frequently Asked Questions in the "Help" section of the Site or call Customer Service and a Team Member will assist you. Aviglatt.com.com gives you Satisfaction Guarantee on all of our products and services are backed by a 100% customer satisfaction guarantee. You can place an order anytime 24/7, orders must be received up to one week before your delivery date. Available delivery windows and associated delivery charges will be shown as you proceed through the ordering process. You can modify an existing order (including the Change of Address*, addition or deletion of items, a change in the delivery date, and the cancellation of your order) by contacting us via Email or calling our Customer Service Telephone number 718-947-1000, However, modified orders are subject to price changes and a change of a delivery date may not guarantee the availability of your desired items and you may cancel an order at anytime (excluding if the order has been already shipped out). Cancelation of an order after the required cut off time (same day that the order was placed) will result in a restocking and cancelation fee as the following:
Customer’s Note: Please provide a valid address and telephone number for deliveries. We will not be held accountable for orders that have not been able to be delivered due to closed businesses or customers not available at the location to receive the delivery. Please make arrangements to pick up your package if it is left with your door man (aviglatt.com will not be held accountable if packages are left and sign for by your door man and given to you at a later time)

Shipping Policy:
All shipping is on Monday, Tuesday, Wednesday, and Thursday. We do not ship on Fridays, weekends, or National and Jewish Holidays.
Free Ground shipping on all orders $150.00 or more on dry grocery items only: Lead time to ship on all orders is 24 – 48 hours excluding Fridays, weekends, or National and Jewish Holidays and then 2 – 5 business days in transit. No refrigerated items such as: frozen, meat, dairy, etc. will qualify for this service. Any Order with refrigerated items under the amount for free next day shipping will be expedited to FedEx Express (overnight Service) at your cost.
Free Next Day Air shipping on all order $700.00 or more on all items such as: Grocery, Frozen, Meat, Dairy, and etc. Lead time to ship on all orders is 24 – 48 hours excluding Fridays, weekends, or National and Jewish Holidays and then 1 business days in transit. Your order must be over $700.00 to get this service. If your order contains dry groceries and frozen or perishable items your shipment will be split in both services to accommodate your items such as dry grocery items will be sent via FedEx ground shipping (2 – 5 business days in transit) and frozen or perishable items will be sent via FedEx Next Day Air shipping (1 business days in transit).
Preparation for shipping on Perishable items are wrapped in double sealed plastic and Flash Frozen to ensure freshness then packed in a cardboard box surrounded with Styrofoam packed with frozen gel packs or dry ice and peanuts then sent out via FedEx Next Day Air shipping (1 business days in transit).
The Flash Frozen Process (or blast freezing) refers to the process in various industries whereby objects are quickly frozen by subjecting them to very low temperatures. For example, flash freezing is used in the food industry to quickly freeze perishable food items. In this case, food items are subjected to temperatures well below water's melting/freezing point (32°F or 0°C), causing the water inside the foods to freeze in a very short period without forming large crystals, thus avoiding damage to cell membranes with Flash Frozen you have the option of freezing the product or using it right away once you have received it. This process lasts up to 48 hours allowing you to receive your items as fresh as possible.

Cancellation will result in a restocking fee equal to the sum of (A) 100% of the total dollar amount of your perishable items (since our perishable items are custom-ordered and guaranteed fresh) plus (B) 25% of the total dollar amount of your nonperishable items.
Returns & No Exchange policy are for dry goods only; if you are dissatisfied with an item that was sent you may return it before the cut off time (7 business days after the order has been delivered). Once the returned merchandise is received a credit will be issued.
Please note a restocking of 25% will be deducted of the total dollar amount of your returned items. Aviglatt.com does not credit back for shipping fees on returns which is a Term you agree to once finalizing the order. We do not accept any returns of Meat, Frozen, Dairy or Perishables items nor do we accept exchanges.
Damaged/Spoiled Claims: If your order arrives damaged or spoiled a report must be made by the customer via email only before the required cutoff time (24 hours from the delivery time), When filing for a damaged claim you must provide your order, tracking number and a picture has to be submitted in the email, the items also must be sent back to us in order to file the claim no exceptions. Claims will not be accepted after 24 hours from the delivery time. A claim will be filed by one of our customer representatives and you will received a decision between 3 to 5 business days after the claim has been made.
Something wrong or Missing Something from you Order? If you feel that something is wrong or missing from your order you must notified us within 24 hours after the order has been delivered by email only. No wrong or missing claims will be accepted after 24 hours of the delivery time.
At Aviglatt.com.com we believe in offering our customers the best product at the best price. We receive fresh products daily to assure you the highest quality. Although our goal is to fulfill 100% of each order, given the perishable nature of our products, from time to time products may be unavailable due to market conditions beyond our control or to quality that is below our standards. We reserve the right to limit your order or the quantity of a particular product that you may request. If we are unable to fulfill your entire order we will make every reasonable effort to contact you prior to delivery. Once you complete checkout, your price, or price per pound/ounce where applicable, is guaranteed unless you placed an order for an item where we have inadvertently listed the incorrect price. In those circumstances, we reserve the right to cancel undelivered orders for such incorrectly priced products; we will contact you immediately in such circumstances and of course your credit card or checking account will not be charged.
Because we custom-cut, select, and order your perishables, the item price you see in your shopping cart for items are priced by the pound/ounce and based on an estimated weight. The final price of these items will be based on the same price per pound/ounce indicated upon completion of checkout, but the actual price is determined once we have prepared and weighed your order, and will appear on the invoice you receive at the time of delivery.
To maintain the integrity of products after delivery, we recommend that you immediately refrigerate or freeze perishable items. We guarantee your products (with the exception of frozen items you ship at your own risk) will remain fresh in the delivery box at room temperature (78 degrees) for two (2) hours from the time of delivery. Frozen items must immediately be placed in a freezer. Aviglatt.com.com Delivers with the shipping company Federal Express, Once the order has been shipped out an email confirmation will automatically be sent to the customer stating that there order has been shipped and a tracking number will be provided. After the package has been shipped it is up to the customer to have make arrangements for someone to be home to receive the package, otherwise Aviglatt.com.com are not held responsible for packages that are released without signature, left at the front door/porch or if someone else you are unaware of receives the package instead. When finalizing an order please provide your date of delivery (Excluding Mondays, weekends and All Major Jewish and American Holidays) otherwise orders will be shipped out with no indication of date.
Additionally, after your second order with Aviglatt.com.com you may elect an alternate receiver located within your building to accept your delivery. This alternate receiver can accept your goods when you are not present at the time you had selected for delivery and shall accept the goods under all of the same terms and conditions that would apply had you accepted the delivery yourself. Anyone at the delivery address who receives the delivery is conclusively presumed to be authorized to receive the delivery, if you choose to have someone else receive your package please provide their shipping information in the order stating that you would like to have this person receive your package for you. If we are unable to deliver the order for any reason, the order will be sent back to our facility and a cancelation fee will apply.
If something is missing from your order, please call our Customer Service department at 718-947-1000 or log on and contact us via our Customer Inquiry e-mail form within 24 Hours after the order has been delivered, otherwise we are not held liable to orders detailed missing or damaged products. In the case of inclement weather, or unforeseen delivery complications, it may be necessary to make adjustments to our delivery schedule, which will cause us to suspend chosen delivery dates and times. If there will be a significant delay, a customer service representative may call or e-mail you to let you know the status of your delivery time. If your destination delivery location (i.e., street, avenue, etc.) or day is inaccessible, rendering us unable to make the delivery, we will contact you to determine the best alternate location and/or date.
Aviglatt.com.com will Charge your credit/debit card for your order on the day your order has been shipped out. Since certain perishables are priced by weight and the actual price is not known until we have prepared and weighed your order, we request credit card authorization for up to 125% of the estimated cost of perishables, but only charge you the actual cost that is determined after preparing and weighing your order. In addition, we will authorize your credit card for an amount equal to 100% of the total of the non-perishable items in your order. Aviglatt.com.com will not process orders that use an incorrect, expired, or over-the-limit credit card. We will make our best efforts to contact you if this occurs. However, in the event such an order is processed, Aviglatt.com.com reserves the right to collect funds for any uncollected transactions owed. Aviglatt.com.com may charge a nominal fee of $2 per order should a payment made via credit card be declined resulting in the need for alternate payment or exception processing. If you fail to pay any fees or charges when due (which would include if a check is returned or electronic payment is rejected) or if a redelivery fee or restocking fee is imposed, Aviglatt.com.com may charge such amount directly to the credit card identified in your Customer Account Information and may suspend or terminate your access to our Service. You shall be responsible and liable for any fees, including attorneys' fees and collection costs, that Aviglatt.com.com may incur in its efforts to collect any unpaid balances from you. Your right to use the Aviglatt.com.com Service is subject to limits established by Aviglatt.com.com and/or by your credit card issuer.
Checking Account Payment to be eligible to pay for your order from a checking account, the following three conditions must be met: 1) you must have received and paid for at least two prior orders. 2) There must be a valid credit card attached to your Aviglatt.com.com customer account. 3) Your Aviglatt.com.com customer account must be in good standing. Your checking account payment will be processed after your food has been prepared and weighed. Aviglatt.com.com will not process orders that use an incorrect or have a overdrawn checking account. We will make our best efforts to contact you if this occurs. However, in the event such an order is processed, Aviglatt.com reserves the right to collect funds for any uncollected transactions owed to it. Aviglatt.com will automatically attempt to process checking account payments two times. If the first request is declined, Aviglatt.com may charge a nominal fee of $2 per order to cover the cost of exception processing. If the second request is declined, Aviglatt.com will charge a $25 bounced check fee. Additionally, in the event that sufficient funds are not available in your checking account, Aviglatt.com will charge the full amount of the order to your credit card. If you fail to pay any fees or charges when due or if a redelivery fee or restocking fee is imposed, Aviglatt.com may charge such amount directly to the credit card identified in your Customer Account Information and may suspend or terminate your access to the Aviglatt.com Service.
Aviglatt.com does not accept paper checks, food stamps, or coupons at any time. In the future, The purchase, payment, warranty, guarantee, delivery, maintenance, and all other matters concerning the merchandise, services, or information ordered or received from such businesses are covered by their customer agreement and policies and solely between you and such businesses. Aviglatt.com makes no representations or warranties of any kind express or implied, regarding the merchandise, services, or information received from such third parties and the fact that Aviglatt.com makes such products, information, and services available should not be construed as an endorsement of the businesses or the products, services, and information they provide. License and Proprietary Rights Copyright and Ownership. In addition, you are responsible for any charges incurred to third-party vendors or content providers prior to your cancelation Notices. Aviglatt.com may give notice to you of a change in this Agreement, a change in the Aviglatt.com Fee Schedule, and any other matter through a general posting on the Aviglatt.com Site, by electronic mail, or by conventional mail to your address contained in the Customer Registration Data.
